VIC:BAT calls for legal advice to be released
MELBOURNE, Aug 23 AAP - A tobacco giant's fight against the introduction of plain packaging
has been dealt a setback by the Federal Court.
But British American Tobacco Australia (BATA) says it might head to the High Court
in its fight against the decision to deny it access to key documents behind the plain
packaging laws.
BATA wants the federal government to release legal advice it says will prove its proposed
plain packaging laws are flawed.
The full bench of the court refused BATA's appeal to access the federal government
document on Tuesday.
The company wanted the Department of Health document from 1995 advising against plain packaging.
The government has refused to release the document under freedom of information, a
decision backed up by the Administrative Appeals Tribunal.
The company says that all MPs voting on the Tobacco Plain Packaging Bill and contentious
Trademarks Bill in parliament on Wednesday need to see the advice on the legality and
constitutionality of plain packaging.
Last month the federal government introduced to parliament legislation that will make
it an offence to sell, supply, buy, package or manufacture tobacco products for retail
sale in anything other than plain packaging.
Under the laws, tobacco products will be sold in dark brown, drab packaging from mid-2012.
BAT released a statement on Tuesday saying debate on both bills must be delayed until
the government stopped withholding the legal advice and it was seen by the parliament.
Company spokesman Scott McIntyre says there is no evidence the world-first introduction
of plain packaging for cigarettes will reduce smoking rates.
He said the illegal tobacco market, which currently occupies 16 per cent of the Australian
market, would increase its dominance, causing a loss of excise revenues.
"When you make packs look exactly the same with the same colour it's going to make
them easier to counterfeit," Mr McIntyre told AAP.
"The retailers won't be able to tell which ones are real and which ones are fakes."
He said they were disappointed not to receive a copy of the legal documents on Tuesday
and were considering legal options including an appeal to the High Court of Australia.
Doctors and health groups have lauded the move, which is backed by the coalition, saying
it will stand as one of Australia's greatest-ever public health achievements.
The maximum penalty for breaching the laws will be $220,000 for an individual and $1.1
million for a body corporate.

BRISBANE, Feb 20 AAP - Two Brisbane Airport cleaners accused of stealing passengers'
luggage have briefly appeared in court.
Richard Kenneth Jones, 28, of Eagleby, and Nicole Georgette Doreen O'Neil, 39, of Daisy
Hill, were both arrested by Australian Federal Police (AFP) officers earlier this month,
but only appeared in court today for the first time.
Jones has been charged with three counts of stealing goods in transit, while O'Neil
faces seven similar charges.

CANBERRA, Feb 11 AAP - During the summer of disasters, Prime Minister Julia Gillard
was criticised for her stoic and seemingly impersonal response to tragedy.
But during a condolence motion for the death of at least 35 people during the floods,
she teared up as she recounted some of the most heartbreaking stories of the floods and
Cyclone Yasi.
Among others, she spoke of teenager Jordan Rice, who died after asking rescuers to
save his 10-year-old brother, and toddler Jessica Keep who was torn from her mother's
arms in the floodwaters.
Tony Abbott was moved enough to concede Gillard had a "decent heart" before he made
his own contribution - perhaps trying to make amends for his description last weekend
of the Labor leader as "wooden".
But, the first week of federal parliament for 2011 was dominated by questions of presentation
and style, the rapprochement proved not to run deep.
By the end of the parliamentary week, Abbott had accused Gillard of having a "tin ear"
when it came to public unrest over the flood levy.
The prime minister shot back, accusing the Liberal leader of having a "tin heart",
referring to his party's call for political donations in a letter about the tragedy of
the floods.
It only needed mention of cowardly lions and scarecrows to turn it into an L. Frank Baum story.
Not that federal parliament was short of a good yarn this week.
Abbott became embroiled in controversy after the Seven Network aired footage of him
discussing the circumstances that led to the death of Lance Corporal Jared MacKinney during
a battle with Taliban insurgents in Afghanistan last year.
In conversation with military chiefs in Afghanistan, Abbott said "shit happens", after
being told that no single factor was to blame for the death of Cpl MacKinney.
A senior soldier replied: "It certainly does, yeah."
Abbott later rang the soldier's widow to explain himself.
But the incident reinforced a view that Abbott reacts without thinking his responses through.
It was reminiscent of a 2007 election campaign incident in which Abbott had to apologise
to asbestos campaigner Bernie Banton after remarking, "just because a person is sick doesn't
mean that he is necessarily pure of heart in all things".
What compounded the problem this week was Abbott's response.
Asked during the news interview to explain the context of the remarks, he froze and
stared in silence for almost 30 seconds.
He later attempted to explain away the reaction as "dignified silence".
The incident came amid turmoil within the coalition over how it would fund the flood
recovery without Labor's levy.
Senior government figures have been egging on the coalition for weeks to come up with
another way of funding the recovery.
Abbott took the bait, revealing a package of budget cuts including funds for Indonesian
schools, suspension of Murray-Darling water buybacks and cutting off the river of money
going into the Building the Education Revolution program.
The launch of the plan was marred by Liberal insiders leaking that Julie Bishop had
argued passionately in the shadow cabinet against cutting foreign aid, which she said
smacked of a One Nation-style approach to the federal budget.
Other party insiders leaked against Bishop, saying she had accepted the aid cuts as
a legitimate budget saving but was trying to dodge responsibility.
The leaks appeared to stem from lingering tension over the deputy's role, which both
Joe Hockey and Andrew Robb are known to covet and which could in time become an albatross
around Abbott's neck.
Robb admitted it wasn't a good look: "It was a disappointing week for us, but I think
the air will be cleared and we will move on."
Bishop acknowledged there was "robust policy debate" in the shadow cabinet room, but
drew a contrast with "zombies" in the Labor Party dumbly accepting the prime minister's
direction.
The prime minister herself faces a leadership challenge of sorts, taking a new health
deal to the premiers at the Council of Australian Governments on Sunday.
The deal - forced on the government by state coalition governments - would scrap an
agreement reached by Kevin Rudd last year in which the states were to hand over a third
of their GST revenues in exchange for 60 per cent federal government responsibility for
hospitals.
The opposition was quick to paint it as yet another example of Labor being unable to
deliver on its promises.
Whether Gillard can convince the states to accept the new deal - based on a 50-50 share
of growth funding put into a single national pool - will be crucial for her to overcome
accusations of inaction.
Her government already faces pressure over the flood levy, the passage of which is
being delayed by a parliamentary inquiry and by crossbenchers who question the budget
cuts that accompany it.
Other major changes - securing the health of the Murray-Darling river system, putting
a price on carbon and the rollout of the national broadband network - also face serious
hurdles.
It will take courage, intelligence and heart for the prime minister to succeed.

Another opinion poll has confirmed voters in the seats of the three independents who'll
decide the next federal government overwhelmingly want the Coalition to take power.
The Newspoll in today's Australian newspaper found more than 50 per cent of voters
in the seats of New England and Lyne in New South Wales .. and Kennedy in Queensland are
backing Opposition leader TONY ABBOTT.
Support for Labor is less than 40 per cent in each of the seats.

BRISBANE, April 21 AAP - Premier Anna Bligh says Queenslanders can expect more hospital
beds, faster elective surgery and better emergency departments under federal health reforms.
Ms Bligh says $755 million in new funds would deliver significant gains for Queensland.
She has returned from Canberra where she signed what Prime Minister Kevin Rudd is calling
an historic deal for the federal government to become the primary funder of Australian
hospitals.
"This was a once in a generation opportunity," Ms Bligh said after agreeing to the deal.
She said she'd secured her wish to get more money into Queensland's heath system sooner,
and a guaranteed level of base funding for the reforms.
Ms Bligh said the new funds include $150 million to set and meet a new service delivery
target of four-hour treatment in emergency departments.
There's also $160 million to make sure more Queenslanders get elective surgery within
clinically recommended times, and $325 million for 270 new sub-acute care hospital beds
over the next four years.
Ms Bligh said there was also $23 million for new community-based services for young
people with mental health problems, and $148 million for aged-care services.

A man's been charged with attempted murder over two separate stabbing attacks outside
a train station in Sydney's south-west.
In August 2006 .. a 20-year-old man was stabbed in the stomach during an unprovoked
attack .. as he walked home from Leumeah station.
Two nights later .. a man approached a group of people near the station .. allegedly
produced a knife and stabbed two people.
A 27-year-old man from Raby has been arrested in Queen Street at Campbelltown.
He's been charged with two counts of attempted murder and three of maliciously inflicting
grievous bodily harm with intent .. and is due to appear in court on January 27.

Fed: Push ahead with republic despite economic woes: Greens
CANBERRA, April 29 AAP - The global financial crisis is no reason to delay taking steps
towards holding a referendum on whether Australia should become a republic, Greens leader
Bob Brown says.
Senator Brown has introduced legislation that would force a plebiscite asking Australians
a "simple yes or no" question about whether they wanted a referendum on the republic issue.
Under the Greens' proposal, the question about whether or not to hold a referendum
would be put on the ballot paper at the next federal election.
Senator Brown said support for a republic had grown since Australia last voted on the
issue 10 years ago.
"The most recent poll on whether Australians should be asked about whether or not they
want a republic showed a two to one majority in favour of that opportunity being given,"
he told reporters on Wednesday.
The Greens leader described as "nonsense" the argument from the monarchists that a
holding plebiscite was tantamount to living in 1930s Germany.
"Australians are a mature nation who can well vote on their own affairs. I think there
should be more questioning opportunities for Australians in telling their politicians
to do more, not less."
Senator Brown said the cost of holding a plebiscite was relatively small and should
not be delayed because of the current financial climate.
"The idea that everything should stop while there is an economic recession has cobbles
on it. Of course we keep evolving and maturing as a society and we need to keep our view
on the long term good of the country as well as the short-term good."
It was also unfair to say that a referendum should be deferred until Queen Elizabeth II died.
"I don't entertain that view at all," he said.
Only eight of 44 referendums held since 1909 have been successful.

SYDNEY, Dec 26 AAP - Despite the gloomy economy, retailers across the country opened
doors to hordes of shoppers eager to snap up a bargain on the first day of post-Christmas
sales.
In Sydney's CBD some lined up as early as 9pm (AEDT) on Thursday, outside department
stores David Jones and Myer.
At David Jones those who were there at 6am (AEDT) on Friday for the store's opening
were greeted with balloons, gift vouchers, and an appearance by singer Delta Goodrem.
Mens' shirt sales were brisk at Myer, and the demand for manchester was also strong.
Harvey Norman's Highpoint Melbourne store was full to capacity by 9.03am (AEDT) - three
minutes after it opened.
Across the country at Big W there was an unusually high demand for lawn mowers and
baby seats. Entertainment equipment and televisions were also popular.
The Australian National Retailers' Association said the fact that many chose to celebrate
Boxing Day by going on a shopping spree was evidence people were becoming more relaxed
about their mortgages.
"Interest rate cuts are starting to filter through," chief executive Margy Osmond said.
She also attributed strong sales to people spending their share of the federal government's
$10.4 billion economic stimulus package.
"There's no doubt a proportion of that has filtered through," she told AAP.
Independent forecaster Access Economics predicts Australians will spend almost $14.6
billion at the shops, compared to $14.1 billion last year, over the Boxing and New Year
period.

Telstra said the customer issues passed on to the telco by Senator Birmingham had been addressed.
Telstra spokesman Peter Taylor said a hotline had been established to help customers
who were experiencing genuine problems with their Next G mobile devices and in some instances
customers had been assisted in swapping over their handsets.
He said people living and working in fringe coverage areas should ensure that they
purchased "blue tick" handsets, which are recommended for handheld use in rural coverage
areas.
"In addition to the establishment of the 1800 888 888 hotline, Telstra has put in place
a number of other programs to make it easier for customers to make the move from the old
CDMA network," Mr Taylor said.
"(This includes) putting extra staff on the road to demonstrate coverage equivalence,
monitoring dropout rates, and introducing a shop accreditation program to ensure customers
get the appropriate advice on Next G handsets and accessories."

Human rights and same-sex lobby groups have hailed the Victorian government's decision
.. to introduce a register for gay couples before the years' end.
Premier STEVE BRACKS announced the moves today .. setting up a register for same-sex
and defacto couples .. plus people in long-term care-giving relationships.
Gay rights activist RODNEY CROOME is now calling on Victoria to match the provisions
contained in Tasmania's register system .. introduced in 2004 .. where unmarried same
and opposite-sex couples can access parenting rights in areas like adoption.
Mr CROOME says he's also urging both state governments to offer reciprocal recognition
to each other's schemes .. so registered couples have full spousal entitlements regardless
of which state they live in.
He says many same-sex couples in Tasmania have reported increased acceptance from their
families .. following the registering of their relationships.

Rain and easing winds overnight have helped Victorian firefighters .. with the dramatic
change in weather stopping three bushfires in their tracks as they approached almost 100
people stuck on Mt Buller skifields.
About 50 firefighters are backing up resort teams to help save assets on the mountain
top .. including ski resorts.
The Department of Sustainability and Environment says about 30 alpine resort staff
had made the choice to defend properties .. meaning they've been stuck on the mountain.
Fire authorities hope to clear Mount Buller Road .. after closing it yesterday .. blocking
access to the mountain top.
Earlier alert messages for several regions have now been withdrawn .. but Woods Point
residents have been told to remain cautious .. with a fire continuing to threaten.

A 53-year-old man will face a Sydney court today .. charged over the stabbing murder
of a nine-month-old baby girl in Sydney's south-west.
Neighbours called police to a Campsie home yesterday morning .. after hearing screams
and seeing an elderly man carrying the baby girl .. who'd been stabbed in the neck.
The baby died before ambulance officers arrived.
The 53-year-old will face Paramatta Local Court later today.

Two women have been killed .. after their car was torn in two in a three-car collision
in Tasmania's north-west.
Two cars .. travelling in opposite directions on the Bass Highway at Doctors Rocks
.. collided just after two o'clock yesterday afternoon.
A Subaru wagon also collided with the cars as its driver tried to avoid the crash.
Two women in a Honda Civic hatchback died instantly.
It's the first fatalities of the Christmas-New Year period.
Indon Bashir Aust (CANBERRA)
Australian authorities remain convinced radical cleric ABU BAKAR BASHIR was involved
in the 2002 Bali Bombings .. despite him being cleared by an Indonesian court.
The Indonesian Supreme Court ruled that BASHIR didn't give his blessing to the bombings
.. overturning his conviction on conspiracy charges in the attack that killed 202 people
.. including 88 Australians.
But JOHN HOWARD says he's powerless to do anything .. no matter how angry the families
of victims might be.
BASHIR says he could now pursue a damages claim against the Indonesian government for
wrongful imprisonment.
UK Women (LONDON)
A 48-year-old truck driver has appeared in court .. charged with the murder of five
prostitutes in Ipswich.
STEVEN WRIGHT has been ordered to remain in custody .. and will reappear for a court
hearing on January 2.
Police arrested WRIGHT on Tuesday at his home in the red-light district .. near where
several of the women were last seen.
A 37-year-old man .. identified in news reports as TOM STEPHENS .. who had been arrested
in the case on Monday .. was released on bail without charge pending further inquiries.

Two deaths are being investigated and doctors warns dozens more people are at risk
.. after the type of blood they received in transfusions wasn't screened for bacteria.
An investigation has found more than 100 incidents involving bacterially contaminated
platelet transfusions have affected people since September 2004.
Two deaths are currently being investigated over the contaminated blood .. but it isn't
known how many blood transfusions have made people seriously ill.
Several Melbourne hematologists say the lack of universal screening is unacceptable
for a blood supply system regarded as one of the world's safest.

Embattled NSW MP STEVEN CHAYTOR's court hearing .. for allegedly assaulting his girlfriend

Vic: Farquharson mate tells of alleged kill threat
GEELONG, Aug 16 AAP - A man has told a Victorian court of his emotional trauma at failing
to act when a "good mate" said he planned to kill his three sons.
Bus driver Greg King is giving evidence today against his friend, Robert Farquharson,
37, who is charged with murdering his three sons by driving them into a dam near Winchelsea,
south-west of Melbourne, last Father's Day.
Mr King has told the pre-trial committal hearing at Geelong Magistrates' Court of a
conversation he had with Farquharson outside a fish and chip shop, several months before
the drownings.
He said the two men had just seen Farquharson's former wife, Cindy Gambino, and Farquharson
had commented that he would "pay her back big time".
Mr King said he asked Farquharson if he was referring to his children and asked what he would do.
"He (Farquharson) just then stared at me in my eyes and said `kill them'," Mr King
told the hearing.
Mr King struggled to speak during his cross-examination, and seemed to choke back tears.
He said he did not want to be in court, but the information he had was destroying him.
He said he found it hard to go to the police with the information, but chose to do
so "because it was wrecking me and wrecking my own family and wrecking my own kids".
Mr King said he thought Farquharson was "bull-shitting" at the time, but went home
and told his wife that he was concerned about the conversation.
Farquharson's lawyer, Russell Sarah, accused Mr King of making the evidence up.
"These statements contain a pack of lies - that's the reason you don't want to be here,"
Mr Sarah told him.
The committal hearing continues before Magistrate Jon Klestadt.

FED: More unannounced checks for nursing homes: Santoro
Nursing homes are to face more frequent spot checks .. to make sure they meet care
and security standards for residents.
Federal Ageing Minister SANTO SANTORO says the changes have been made in response to
recent reports of elderly abuse.
Mr SANTORO also wants mandatory police background checks for all aged care workers.
He'll meet with state ministers in Canberra today .. to discuss other possible changes
to the sector.

Fed: Howard condemns racial violence in Sydney
SYDNEY, Dec 12 AAP - Attacking people on their basis of their race is totally unacceptable,
Prime Minister John Howard says.
But Mr Howard today refused to call Australians racist following the mob violence in
Sydney yesterday.
He condemned incidents in which up to 5,000 people descended on North Cronulla Beach,
chanting racist slogans and attacking people of Middle Eastern appearance.
The violence sparked apparent reprisal attacks late last night, with cars damaged at
Maroubra Beach.
"Mob violence is always sickening," Mr Howard told reporters.
"Attacking people on the basis of their race, their appearance, their ethnicity, is
totally unacceptable and should be repudiated by all Australians irrespective of their
own background and their politics," he said.
"I believe yesterday's behaviour was completely unacceptable but I'm not going to put
a general tag (of) racism on the Australian community.
"I think it's a term that is flung around sometimes carelessly and I'm simply not going
to do so."
Mr Howard also dismissed any suggestion his government's warnings about home-grown
terrorists had fuelled the rampage.
"It is impossible to know how individuals react but everything this government's said
about home-grown terrorism has been totally justified," Mr Howard told reporters in Sydney.
"It is a potential threat. To suggest that one should remain silent ... knowing what
I know because that might antagonise someone else is a complete failure of leadership."
Mr Howard said he fully supported the actions of police at Cronulla and anybody who
broke the law yesterday or on the previous weekend, when two lifeguards and a camera crew
were assaulted, should be apprehended and prosecuted.
Mr Howard warned anyone considering further violent behaviour they would face the full
force of the law.
"Nobody in this country has a right to take the law into their own hands.
"It applied to the behaviour of people yesterday, it applied to the behaviour of people
on the beach the previous weekend.
"Any action the NSW Police take in response to that has my full support."

Heartland Payment Systems and United Refining partner to provide SmartLink.(PARTNERSHIP)
United Refining Company, an independent refiner and marketer of petroleum products has partnered with Heartland Payment Systems, one of the nation's largest payments processors, to provide Heartland's SmartLink network services to all United Refining locations in New York and Pennsylvania. The SmartLink technology consolidates multiple in-store devices onto one high-speed broadband line, saving owners time and money while increasing the efficiency of their operations.
SmartLink is a secure, managed network service that effectively supports transaction data and back-office systems, allowing petroleum and c-store operators to spend less time managing aging their networks and more time focusing on their business. SmartLink's merchant gateway provides operators with monitored, firewall-protected, VPN communications for automatic tank gauges, in-store environmental control systems, back-office systems, digital signs, email and Internet. SmartLink's payment gateway provides a distributed and segmented SSL network to support transactions generated by point-of-sale (POS), money order, check cashing, ATM, and fleet card terminals.

Service Revenues Up 32% Over Q1 2010
Non-GAAP Operating Profit Increases 74% Over Q1 2010
BOSTON -- Sapient (NASDAQ: SAPE) today reported the following financial results for the first quarter ended March 31, 2011:
* Service revenues were $241.3 million compared to $183.2 million in the first quarter of 2010, an increase of 32%. Sequentially, service revenues were up $18.5 million, or 8%, from $222.9 million in the fourth quarter of 2010. On a constant currency basis, revenues increased 30% over the first quarter of 2010 and 8% sequentially.
* GAAP income from operations was $18.5 million, or 7.7% of service revenues, up 105% from $9.0 million, or 4.9% of service revenues, reported in the first quarter of 2010.
* Non-GAAP income from operations was $25.8 million, or 10.7% of service revenues, up 74% from $14.8 million,or 8.1% of service revenues, reported in the first quarter of 2010.
* GAAP diluted net income per share was $0.09, compared to $0.05 in the first quarter of 2010.
* Non-GAAP diluted net income per share was $0.12, compared to $0.07 in the first quarter of 2010.
