NSW: Woman wins $550,000 for powerline phobia
A woman who developed a phobia about powerlines after several fell on her when a termite-infested
pole snapped has been awarded today more than $550,000 in damages.
SUZANNE CLARKE-NASH, 37, sued Energy Australia in the NSW District Court for negligence
for when she became entangled in powerlines on a North Sydney street on March 5, 1997.
Judge BRIAN HERRON, in delivering his judgment in the case, has said that Ms CLARKE-NASH
was in the wrong place at the wrong time.
He said the pole snapped while Energy Australia workers replaced wires carried by the pole.
Judge HERRON has found Energy Australia was negligent by failing to inspect the pole
for termites before carrying out the work.
He awarded Ms CLARKE-NASH $557,223 in damages.
Energy Australia are seeking to appeal the judgment.
